Welcome to Kastor. These Terms of Service ("Terms") govern your access to and use of Kastor's services, including our website (getkastor.com), mobile applications, APIs, and all content created through our services ("Generated Content"). Together, these are referred to as our "Services."
1. Agreement to Terms
By using Kastor, you agree to these Terms. If you're using Kastor on behalf of a company or organization, you confirm that you have the authority to bind that entity to these Terms.
2. Changes to Terms or Services
We may modify these Terms at any time. We'll notify you of material changes by posting the updated Terms on our website or via email. Your continued use of the Services after changes means you accept the new Terms. We may change or discontinue any part of the Services at any time without notice.
3. Account Registration and Trial
- You must be at least 18 years old to use our Services
- You need to create an account to access our Services
- Registration requires a valid email address
- You are responsible for maintaining account security
- We offer a free trial period for new users (duration specified during registration)
- No payment information is required for trials
- Upon trial expiration, a paid subscription is required to continue using our Services
- You are responsible for maintaining the confidentiality of your account credentials
3A. Beta Access and Waitlist
For a limited time, we offer Beta Access as well as access to a waitlist to be notified of general availability:Beta Access
- Beta access is offered on a limited, invitation-only basis
- Beta users may use Kastor without charge during the beta period
- The beta period's duration is at Kastor's sole discretion and will be communicated in the invitation.
- Beta access may be revoked at any time without notice
- Beta features may change, be limited, or become unavailable
- We may collect additional feedback and usage data from beta users
- Beta users acknowledge they are using pre-release software that may contain bugs or errors
- We make no guarantees regarding uptime, reliability, or data preservation during beta
- These Terms apply fully to beta users
- Upon beta conclusion, continued use requires conversion to a paid subscription
Waitlist Program
- Joining our waitlist does not guarantee future access
- Waitlist position does not guarantee priority access
- We may offer special pricing or promotions to waitlist members at our discretion
- Waitlist communications are considered informational and not contractual offers
- You may unsubscribe from waitlist communications at any time
- We may use waitlist signup information to contact you about Kastor's launch and related promotions
- Your place on the waitlist is non-transferable
4. Subscription and Payments
- Paid subscriptions begin after trial expiration
- All subscription fees are payable in advance and non-refundable
- We offer monthly and annual billing cycles
- We reserve the right to modify our pricing with advance notice to subscribers
- You may cancel your subscription anytime; cancellation takes effect at the end of your current billing period
- We do not offer refunds for partial billing periods
5. Fair Use and Service Protection
To maintain service quality for all users, we implement the following policies:
- Usage limits apply to all accounts (approximately 50 long-form pieces or 500 short-form posts monthly)
- Higher tier subscriptions may receive higher usage limits
- We monitor usage patterns and may implement rate limiting
- We reserve the right to suspend or terminate accounts that demonstrate abusive behavior or exceed reasonable usage limits
- In cases of suspected abuse or violation of these Terms, we may terminate subscriptions immediately, even during a paid period
- No refunds will be issued for terminations due to abuse or violations of these Terms
6. Content Rights and Ownership
Your Content
- You maintain ownership of all content you submit to our Services
- You grant Kastor a worldwide, non-exclusive license to use your content solely for:
- Operating and maintaining our Services
- Processing your content through our AI technology partners (such as Anthropic and OpenAI) to generate the content you request
- Improving our AI models and service quality
- Internal analysis and service optimization
- We will not share your content with other users or publish it publicly
- Your content will only be processed by our systems, our AI technology partners, and authorized personnel
- All content sharing with our AI partners is subject to their respective security and privacy standards
- You warrant that you have all necessary rights to share your content with us
- We recommend not uploading sensitive or confidential information to our Services, as it will be processed by our AI partners
Generated Content
- You receive full commercial rights to use Generated Content
- You may modify, adapt, and monetize Generated Content
- Kastor and our AI technology partners retain all rights to the underlying technologies and systems
- Generated Content must be used in compliance with these Terms
AI Processing & Data Handling
Our Services uses multiple third-party AI providers, including:
- Anthropic
- OpenAI
- Other AI services as needed
Important data considerations:
- Content processed through these services is subject to their respective terms and data practices
- We strongly recommend against sharing sensitive or confidential information through our Services
- Any content you input will be processed by our AI partners
- While we maintain security measures, we cannot guarantee complete confidentiality of processed data
- Consider the public nature of AI processing when sharing business information, personal data, or proprietary content
- We do not guarantee the availability of specific AI providers
7. Prohibited Uses
You agree not to:
- Use our Services for spam generation or misleading content creation
- Create content that promotes harm, discrimination, or illegal activities
- Violate intellectual property rights or applicable laws
- Attempt to reverse engineer our systems
- Attempt to circumvent usage limits or automated content generation restrictions
- Use our Services for unlawful or fraudulent purposes
- Engage in any activity that disrupts or interferes with our Services
8. Service Availability and Support
- Services are provided "as is" without guarantees of uptime
- We do not guarantee uninterrupted or error-free operation
- We may perform maintenance or updates at any time
- Support is provided according to your subscription tier
- Service availability is dependent on third-party AI providers
9. Account Suspension and Termination
We retain the right to:
- Suspend or terminate accounts that violate these Terms
- Terminate accounts for suspected abuse or excessive usage
- Disable access to Services without prior notice if necessary
- Immediately terminate accounts for severe violations, including but not limited to: illegal activities, security threats, harassment, or attempts to harm our Services or other users
For regular subscription cancellations:
- You may cancel your subscription at any time by contacting our support team
- Cancellation will take effect at the end of your current billing period
- You will maintain access to the Services until the end of your paid period
- No refunds will be issued for the remaining portion of your billing period
- We are not obligated to provide access to or copies of any content after account termination
10. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." KASTOR MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. Kastor does not warrant that the Services will function uninterrupted, error-free, or securely.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KASTOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO YOUR USE OR INABILITY TO USE THE SERVICES.
Kastor's total liability for any claims arising under these Terms shall be limited to the amount paid by you to Kastor for use of the Services in the twelve (12) months prior to the incident giving rise to the liability.
12. Indemnification
You agree to defend, indemnify, and hold harmless Kastor and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from or related to:
- Your use of the Services
- Your violation of these Terms
- Your violation of applicable laws or regulations
- Your User Content
- Any content generated through your use of the Services
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Delaware.
14. Dispute Resolution
a) Agreement to Arbitrate
You and Kastor agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services will be resolved through binding arbitration, rather than in court, except that:
- You may assert claims in small claims court if your claims qualify
- Either party may seek injunctive relief for intellectual property violations
- Either party may seek emergency equitable relief
b) Arbitration Rules and Forum
- The arbitration will be administered by the American Arbitration Association ("AAA")
- The AAA's Consumer Arbitration Rules will govern
- The arbitration will be conducted in English
- The arbitration may be conducted in person, through document submission, by phone, or online
- The arbitrator's award will be final and binding
- The arbitrator can award any relief that would be available in court
c) Arbitration Location and Costs
- Any in-person arbitration hearings will be held in Delaware
- We will reimburse arbitration filing fees for claims under $10,000 unless deemed frivolous
- Each party will pay their own attorneys' fees and costs unless the arbitrator determines otherwise
- We will not seek attorneys' fees or costs in arbitration unless the claim is frivolous
d) Class Action Waiver
YOU AND KASTOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION. If this provision is found unenforceable, the entire arbitration agreement will be null and void.
e) Opt-out Rights
You may opt out of this arbitration agreement by emailing team@getkastor.com within 30 days of first accepting these Terms, stating your intent to opt out of arbitration.
f) Changes to This Section
If we make any future changes to this arbitration agreement (other than a change to our notice address), you may reject the change by sending us written notice within 30 days of the change.
g) Survival
This arbitration agreement will survive any termination of your relationship with Kastor.
h) Exceptions to Arbitration
Notwithstanding the above, either party may bring an individual action in small claims court. Nothing in this arbitration agreement prevents you from bringing your dispute to the attention of any federal, state, or local government agencies. Such agencies can, if the law allows, seek relief against us on your behalf.
15. General Terms
- These Terms constitute our entire agreement
- If any provision is found invalid, the rest remain in effect
- We may assign these Terms; you may not without our consent
- Notices will be sent via email or posted on our website
